Jon and Kate Gosselin will still be husband and wife in 2010, as the couple are waiting to finalize their divorce, TVGuide.com has confirmed.

Although the Jon & Kate Plus 8 stars must wait until at least early next year for their divorce to become final, Jon Gosselin's lawyer, Mark Jay Heller, tells TVGuide.com he's confident about the divorce proceedings, as is his client.

"Jon is optimistically looking forward to the new year," Heller says, "When he can join hand-in-hand with his former wife to pursue an amiable and a cordial and a cooperative effort in the role of mom and dad."

Heller says Jon plans to extend himself to his estranged wife over the holidays and hopes to usher in the new year with Kate as a team. "He's very hopeful that in the role of mom and dad, they will have a much happier ending than they did as husband and wife."

The Gosselins filed for divorce earlier this year after 10 years of marriage. An arbiter is currently working out custody and finance-related decisions. Jon & Kate Plus Eight wrapped its five-season run on Nov. 23.
