Judge to Lindsay Lohan: Plea Deal Means Jail Time

A judge told Lindsay Lohan on Wednesday that she will go to jail if she accepts a plea deal on a charge of stealing a $2,500 necklace.
Los Angeles Superior Court Judge Keith Schwartz, addressing the actress directly, said he will sentence her to jail if she pleaded guilty or no contest to the felony charge. He did not specify the length of the sentence.

"I treat everybody the same," Schwartz said. "I don't care that you're Lindsay Lohan. What I look at is, 'What are the charges?'" The details of the plea deal were not immediately released, but Schwartz said he didn't think Lohan would take prosecutor Danette Meyers' offer. Lohan pleaded not guilty two weeks ago.Lohan and her lawyer, Shawn Chapman Holley, have until March 10 to decide what to do. If she does not accept a plea deal, the case will go to a preliminary hearing during which prosecutors will present their evidence.The charge stems from an allegation that Lohan, 24, stole the pricey necklace from a Venice, Calif., store on Jan. 22, nearly three weeks after she was released from court-ordered rehab.

Lohan remains on probation from her 2007 drunken driving case and was sent to jail twice last year for violating probation, which requires her to obey all laws and submit to random drug tests. Riverside County prosecutors are also considering charging Lohan with battery for a December altercation with a Betty Ford Center employee. She was ordered to go to rehab for three months after she admitted to failing a drug test in September.Los Angeles Superior Court Judge Elden S.
