Last week the 24-year-old admitted on Twitter that she had failed a court-ordered drug test. "This was certainly a setback for me but I am taking responsibility for my actions and I'm prepared to face the consequences," she wrote.
Unlike her last stint behind bars, Lohan will not get out of jail early. "Ms. Lohan cannot be released early because this isn't a jail sentence," L.A. Sheriff's spokesman Steve Whitmore told People. "She's being held by court order until her hearing on Oct. 22."
Lohan's attorney Shawn Chapman Holley filed an appeal later on Friday arguing Lohan was unlawfully denied bail, according to People.
This is the actress' third stint in jail stemming from a 2007 DUI charge. She served 84 minutes that year and then 13 days of a 90-day sentence this summer for violating probation, after which she attended a drug-rehab program.
Upon her release from rehab, Fox had stipulated that any missed or failed drug tests would result in a 30-day sentence.
