Holmes, 24, appeared in the Aurora District Court on Monday morning where he learned that he'll be charged with two counts for each person he's accused of killing during the July 20 shooting spree. One count is for showing premeditation and the other for "extreme indifference to life."
Additionally, he's charged with 116 counts of attempted first degree murder, one count of possessing an explosive device and one count of violent crime. Prosecutors have 60 days to decide if they'll seek a death sentence.
Holmes killed 12 people and injured 58 others during the worst mass shooting in U.S. history. The wounded victims ranged from 3 months old to age 45.
