Donald Trump said Monday that he plans to sue Bill Maher to the tune of $5 million for a joke the comedian made at Trump's expense during a January appearance on The Tonight Show with Jay Leno.

While he was being interviewed by Leno, Maher brought up Trump's repeated requests for President Barack Obama to release his birth certificate. Maher quipped that he would donate $5 million to charity if Trump produced a certificate proving that he was not the "spawn of his mother having sex with an orangutan."

In response, Trump released his birth certificate almost immediately, and has maintained that Maher owes him $5 million because he did so. But on Monday'sFox & Friends, Trump indicated that he's actually taken legal action against Maher.

"He promised me $5 million for charity if I provided certain information," Trump said. "Well, I provided the information, he didn't pay. So today, I sue Bill Maher for $5 million for charity."

When told the lawsuit might be dismissed because Maher was clearly joking about the offer, Trump disagreed.

"I don't think he was joking," Trump said. "He said it was venom. That was venom. That wasn't a joke."
