Judge Denies CBS' Restraining Order Request Against Glass House

It seems ABC has won this round.

A judge has denied CBS' request for a temporary restraining order that would've prevented ABC's The Glass Housefrom premiering next week, according to The Hollywood Reporter.

To refresh, CBS believes ABC's new reality series The Glass House is a direct rip-off of its long-running hit Big Brother. The Glass House, which is set to premiere on Monday, June 18, follows 14 contestants as they live together and compete for $250,000. Similar to Big Brother, contestants will go head-to-head in competitions and will be eliminated weekly. Unlike Big Brother, America will have the chance to vote, manipulating different outcomes within the house.

CBS continues its fight against ABC in Glass House vs. Big Brother smackdown

On Friday, Federal Judge Gary Allen Feess declined to issue the temporary restraining order, stating that ABC would end up losing in the long run since the crew would lose their jobs, the contestants would lose the time and effort put into the show and the network would lose its investment in the reality series.

While the judge noted that there were similarities between the two series, "The idea, in my view, cannot be copyrighted," he told the court. Still, the judge said CBS could continue with further legal action.

ABC files counterclaim against CBS

"We appreciate the Court's continuing consideration of this case and our request for an injunction," CBS said in a statement. "Win, lose or draw on the [temporary restraining order], we fully intend to proceed with our claims against Disney/ABC for copyright infringement and misappropriation of trade secrets over The Glass House, which may still warrant more injunction proceedings depending on the content of each episode. At the same time, we will move forward with our individual claims for liability and liquidated damages against any current The Glass House producer who violated their Big Brother confidentiality agreement."
