Former O.C. star Mischa Barton is planning to accept a plea agreement in her DUI case, which will keep her out of jail, People reports.According to the report, Barton, who was arrested for DUI in Los Angeles on Dec. 27 (a first-time offense), will plead no contest at her arraignment Thursday. She will be sentenced to a three-month alcohol-education class, will pay a $1,700 fine and will serve unsupervised probation for three years. Additionally, since only a small amount of marijuana was found, the pot-possession charge will be dropped, and the charge of driving without a license will be reduced to a minor violation. Shortly after I posted my story on Friday about Gossip Girl courting Barton for a juicy arc, her reps began issuing blanket denials to various media outlets, insisting that, although their client was indeed approached by the show, she turned the gig down. There's just one problem: She didn't. Turn them down, that is. At least not formally.Reliable sources close to the CW phenom tell me that the recent statements made by Barton's camp took Gossip execs Stephanie Savage and Josh Schwartz by surprise since, as far as they were concerned, Barton was still in the running to play schemer Georgina Sparks. Their ears didn't deceive them: Those whispers that Gawker.com overheard about Mischa Barton being approached for a part on Gossip Girl, I can now report, are 100 percent true. What isn't 100 percent is whether or not a deal will be struck for her to play the recurring role of Georgina Sparks, a scheme queen who brings Serena's checkered past screaming into her present — although it's looking more unlikely with each passing hour. Shortly after we posted this story, Barton's reps told US Weekly that she turned down the gig. My sources, however, have yet to confirm that. The mere fact that Barton was even considered for the role suggests that if ever there was an ax to grind between Gossip monger Josh Schwartz, who killed Barton off of The O.C., and the starlet, that hatchet was buried along with the nubile body of Marissa Cooper. Mischa Barton was charged Tuesday with driving under the influence and possession of marijuana, following her arrest in December. The former O.C. star (and Keds spokesperson) was also charged for driving without a valid license.Barton was arrested Dec. 27 in West Hollywood on an investigation of DUI for reportedly using two lanes while driving, plus failing to signal when making a turn. Her arraignment is scheduled for Thursday in Beverly Hills. Unfortunately for Barton — and as other fellow fashionable DUI arrestees can attest (I'm talking to you, Paris) — her well-known style sense will likely not improve her standing in a court of law.
