Michael Lohan: Lindsay to Check Out of Rehab Next Week
Lindsay Lohan will check out of rehab after three months next Tuesday, her father told CNN.
The actress voluntarily entered the Betty Ford clinic on Sept. 27, three days after she violated her probation with a failed drug test. Los Angeles Superior Court Judge Elden Fox allowed the 24-year-old to stay in rehab instead of going to jail for the violation, but set her earliest release date for Jan. 3 to prevent any New Year's Eve partying.
Report: Battery charges against Lindsay Lohan dropped
Michael Lohan said he was busy preparing for his daughter to move into a new Los Angeles home after she checks out.
Earlier this month, Lohan was investigated for an alleged misdemeanor battery charge against an unidentified Betty Ford staffer during an early morning dispute on Dec. 12. The staffer was fired after giving an interview about the incident.
The actress is still on probation stemming from a 2007 DUI case. She's due back in court Feb. 25 and is subject to random drug testing in between her release from rehab and the court date. Judge Fox told her at her October hearing that any violation will result in a mandatory 180-day jail sentence.

The recent ruling marked the fourth time Lohan avoided a lengthy jail stay in her DUI case. She served 84 minutes in 2007 and then 13 days of a 90-day sentence this summer for violating probation, after which she attended a drug-rehab program.
