Judge Extends Ariel Winter's Guardianship; Evidence of Emotional Abuse Found

Modern Family's Ariel Winter will remain under the temporary guardianship of her sister after evidence of emotional abuse by her mother was presented in court, The Associated Press reports.

Los Angeles Superior Court Judge Michael Levanas ruled Tuesday at a hearing that Winter's mother, Chrisoula Workman, will not regain custody of her 14-year-old daughter. Winter had been removed from her mother's home six weeks ago and placed with her sister Shanelle Gray after an initial guardianship hearing determined that she was suffering from abuse. Workman has denied the allegations, but a report by child protective services cited in Tuesday's hearing found "substantiated" evidence of emotional abuse. Evidence of physical abuse, however, was "inconclusive."

The judge also denied a guardianship request filed by Winter's father, Glenn Workman, and added that he wants to help the family work towards reconciliation rather than let the Department of Children and Family services take over the case.
"I guarantee if it stays here, it will get better," Levanas said.
A trial to determine Winter's permanent guardianship has been set for Dec. 12.
